TERMS AND CONDITIONS – ONYX MASSAGE, WELL-BEING & SPIRITUAL SERVICES

 

Deposits, Cancellations & Refunds

A minimum 50% deposit of the total fee is required to secure all bookings.
Deposits are non-refundable and will be deducted from the final balance following the session.

A minimum of 24 hours’ notice is required to cancel or reschedule an appointment.
Cancellations or rescheduling with less than 24 hours’ notice will result in forfeiture of the deposit, which cannot be transferred to a future booking.

No-shows or same-day cancellations will result in forfeiture of the full session fee.
Any outstanding balance will be invoiced and must be paid in full.

Late Arrival Policy

Clients are required to arrive on time for their scheduled appointment.
Late arrival will not extend session time.

Arrivals more than 15 minutes late may result in session cancellation at the practitioner’s discretion, with all fees forfeited.

Behavior Policy

Rude, aggressive, inappropriate, abusive, sexual, or unwanted behavior of any kind will not be tolerated.

If such behavior occurs, the session will be terminated immediately.
All payments made (deposit or full amount) will be forfeited, with no refund provided.

Onyx reserves the right to permanently refuse future bookings.

Right to Refuse or Terminate Service

Onyx reserves the absolute right to refuse or terminate services at any time, without obligation to provide justification.

This includes (but is not limited to):

• Boundary violations

• Intoxication or suspected substance influence

• Failure to follow practitioner instructions

• Misrepresentation or omission of relevant information

Termination of service does not entitle the client to a refund.

Intoxication & Substance Use

Clients must not attend sessions under the influence of alcohol, recreational drugs, or any substance that impairs judgement or behavior.

If intoxication is suspected, the session will be cancelled and all fees forfeited.

Accuracy of Client Information

By completing a booking, you confirm that all information provided is accurate, complete, and truthful, including (but not limited to):

• Medical conditions

• Injuries

• Allergies or sensitivities

• Medications

• Physical or mental health considerations

Failure to disclose relevant information may result in cancellation, forfeiture of fees, or adverse outcomes, for which Onyx and its practitioners accept no liability.

LEGAL DISCLAIMER & LIMITATION OF LIABILITY

Nature of Services

Onyx provides holistic, well-being, massage, Reiki, intuitive, psychic, and mediumship services.

These services are not substitutes for medical, psychological, legal, financial, or professional advice.

All intuitive or mediumship messages are subjective and interpretive in nature and are provided for spiritual and personal insight only.
No outcomes or guarantees are stated or implied.

Client Responsibility for Decisions

By booking a session, you acknowledge that:

• You are solely responsible for all decisions, interpretations, and actions taken during or after your session.

• Onyx and its practitioners are not responsible for how information is used.

• You agree not to pursue any claim based on personal decisions or outcomes.

No Liability for Use of Information

Onyx and its practitioners accept no liability for:

• Emotional or psychological distress

• Mental or emotional impact

• Financial decisions

• Relationship outcomes

• Lifestyle or personal changes

Any guidance, insight, or prediction is not guaranteed and may not come to pass.
Participation is voluntary and undertaken at your own risk.

Premises & Physical Safety

While reasonable care is taken to maintain a safe environment, Onyx and its practitioners are not liable for:

• Accidents, injuries, or incidents occurring on or off the premises

• Allergic reactions or sensitivities to oils, incense, crystals, sound, treatments, or energy work

• Loss, theft, or damage to personal belongings

Clients accept full responsibility for their wellbeing while attending any session.

Video Surveillance & Security Monitoring

The premises are monitored by video surveillance for the purposes of:

• Staff safety

• Client safety

• Security of the premises

• Incident verification and dispute resolution

• Surveillance footage may be retained, reviewed, and used as a precautionary and evidentiary measure in the event of behavioral incidents, complaints, disputes, or legal or insurance matters.

• By entering the premises and/or completing a booking, you consent to video surveillance in accordance with applicable NSW privacy and surveillance laws.

• Video surveillance does not operate in bathrooms or private changing areas.

• Refusal to accept the presence of surveillance constitutes refusal of service.

Independent Practitioners & Contractor Status

You acknowledge and agree that:

• Catherine Eliopoulos, Kylie Renton, and Amanda Jane Richards operate as independent contractors working from the Onyx premises.

• Each practitioner is separately responsible for their own services.

• No practitioner is responsible or liable for the conduct, services, advice, or outcomes of another.

Comprehensive Release of Liability

By completing a booking, you fully release, indemnify, and hold harmless:

• Catherine Eliopoulos

• Kylie Renton

• Amanda Jane Richards

• Onyx Massage & Well-Being (Onyx Maw)

• All staff, contractors, practitioners, and representatives from any and all claims, including injury, loss, distress, dissatisfaction,

       damage, or outcomes arising directly or indirectly from:

• Any session or service

• Reliance on information provided

• Presence on the premises - to the fullest extent permitted by law.

Children & Minors

Services for minors require parent or legal guardian consent.
Onyx reserves the right to refuse services to minors at its discretion.

​

Workshops, Classes & Group Sessions

Bookings for workshops, circles, classes, and group sessions are non-refundable unless otherwise stated.

Missed sessions are not transferable.
Behavior and conduct policies apply equally to group settings.

​

Force Majeure

Onyx is not liable for cancellations or disruptions caused by events beyond reasonable control, including illness, emergencies, natural disasters, power outages, or government restrictions.

Where possible, sessions may be rescheduled. Refunds are not guaranteed.

Governing Law

These Terms and Conditions are governed by the laws of New South Wales, Australia.
Any disputes are subject to the exclusive jurisdiction of NSW courts.

Final Acknowledgement & Binding Acceptance

By completing a booking, you guarantee and confirm that:

• You have read, understood, and accepted all Terms, Conditions, Policies, and Legal Disclaimers in full.

• Completion of a booking constitutes irrefutable acceptance of these Terms.

• Claims of failure to read or understand these Terms will not be accepted.

• These Terms are binding and survive the completion, cancellation, or termination of services.
